"Data API" refers to the DepthSignals structured data endpoints at depthsignals.com/v1/data/*, including REST and WebSocket interfaces.
"Data" refers to all information delivered through the Data API, including but not limited to: structural levels, liquidity events, zone events, regime shifts, confluence-scored signals, and pattern performance statistics.
"Subscriber" refers to any individual or entity that holds an active API key.
DepthSignals grants Subscriber a non-exclusive, non-transferable, revocable license to access and use the Data for the Subscriber's own internal purposes, subject to these terms and the Subscriber's active tier.
Subscriber shall NOT:
All Data, scoring methodologies, detection algorithms, pattern libraries, and the underlying proprietary architecture remain the exclusive intellectual property of DepthSignals. No ownership or IP rights are transferred through API access.
The Data is provided as processed output. The proprietary methods used to generate this output — including confluence scoring formulas, zone qualification gates, event detection thresholds, and pattern conditions — are trade secrets protected under applicable law.
The Data is provided "as is" without warranty of any kind. DepthSignals does not guarantee the accuracy, completeness, or timeliness of any data delivered through the API.
The Data does not constitute financial advice. Trading involves substantial risk. Subscriber is solely responsible for any trading decisions made using the Data.
Past performance of signals, patterns, or strategies does not guarantee future results.
API access is subject to per-minute and per-day rate limits as specified in the API documentation. Sustained abuse may result in temporary or permanent key revocation without refund.
DepthSignals reserves the right to monitor API usage patterns to detect potential reverse engineering, redistribution, or terms violations. Usage data (request counts, endpoints accessed, timing patterns) is logged for this purpose.
API responses may contain per-client watermarks for data provenance tracking. Attempts to remove or circumvent watermarking constitute a terms violation.
DepthSignals may revoke API access immediately upon discovery of terms violations, without prior notice or refund. Subscriber may terminate access at any time by revoking their API keys.
Upon termination, Subscriber must delete all cached or stored Data obtained through the API within 30 days.
In no event shall DepthSignals be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Data API, including but not limited to trading losses, lost profits, or data loss.
DepthSignals' total liability shall not exceed the fees paid by Subscriber in the 3 months preceding the claim.
These terms shall be governed by and construed in accordance with applicable law. Disputes shall be resolved through binding arbitration.
DepthSignals reserves the right to modify these terms at any time. Continued use of the API after modification constitutes acceptance of the updated terms. Material changes will be communicated via email to active Subscribers.
